The subject of this monograph is the issue of house searches within the framework of Criminal Procedural Law. Its aim is to highlight house searches as a procedural act with dual functionality and to provide a comprehensive understanding of the high degree of intrusiveness of this procedural measure on the individual right to asylum.
Specifically, the work begins with documenting the multilayered protection afforded to the inviolability of the home in both domestic and international legal orders. In the second part, the investigative act of the house search is presented in detail, as provided for in the Greek Code of Criminal Procedure (ΚΠΔ), through an outline of its key morphological characteristics and the conditions for its lawful conduct.
Subsequently, the limits of authority of those conducting the house search are examined, which are also influenced by additional parameters. Then, the network of procedural rights of the person affected by the house search is investigated, as well as the remedies available for legal protection against unlawful state interventions in domestic inviolability.
The final chapter of the monograph is dedicated to carrying out house searches within the framework of international judicial cooperation in the field of criminal evidence. This monograph offers a comprehensive and well-founded analysis of the legal framework of house searches both in theoretical and practical terms, emphasizing its importance in the changing European legal environment and promoting solutions for its legal implementation.
